What if my ex won’t try mediation?

To begin with, mediation is voluntary. No one can be forced to attend, and no one is obliged into anything that they do not want. However, things may be difficult if mediation is refused outright.

Behind Family Dispute Resolution (mediation) is a broader legal process which involves the powers of the Federal Circuit and Family Court. When mediation is inappropriate for the circumstances, matters can progress into the court system. Changes to this court have meant there are more questions asked if mediation is refused or if one party does not genuinely attempt to negotiate. It is possible that there will be repercussions for their case if the matter progresses to court.

At Blackboard Mediation, we cannot force a parent to attend mediation. We make a thorough effort to contact and explain the process to every parent involved, but are sometimes unable to reach some parents if we have not been given sufficient contact details.
