Can we do mediation during a lockdown?

Lockdowns are difficult for so many reasons. Some parenting arrangements may need to change. While children have a right to a meaningful relationship with both of their parents, this is does not mean that their safety should be compromised. For most people, online mediation is the only option available during lockdown.

While most states have put measures in place to allow children to maintain their current arrangements with their parents, each lockdown has different rules. Travelling for pick-up/drop-off times has been covered under ‘caregiving’ in some states, but this may change at any time.

We have been asked whether parents are required to continue with any arrangements that are contained in court orders. In most circumstances, the answer to this question has been that court orders and parenting arrangements should be followed, unless there are extenuating circumstances. Independent legal advice may be necessary.

It goes without saying that the best approach is to cooperate with the other parent where possible. Children are having as many difficulties as adults, with their schooling, social lives and usual activities interrupted. It is best that they do not have family conflict to deal with on top of these changes.
